COLUMBUS, Ohio (AP) — A judge’s decision is being upheld by a Federal appeals court to put a hold on Ohio law prohibiting doctors from performing abortions based on a fetal diagnosis of Down Syndrome.
The Ohio Attorney General’s Office says it will seek reconsideration by the full 6th circuit, this comes after the 2-1 ruling Friday from the 6th Circuit Court of Appeals in Cincinnati who says the law passed in 2017 is likely unconstitutional.
Ohio Department of Health as well as the state medical board and county prosecutors were sued by The American Civil Liberties Union over the law on behalf of Planned Parenthood and several abortion providers.
A temporary hold was placed on the law last year when a judge stated the state can not limit a woman’s right to terminate a pregnancy before viability.
