Man Arrested After Breaking into Home to Drink Beer in Ross County

A 42-year-old Chillicothe man, James Horne, was arrested on February 22, 2025, after forcibly entering a residence on Western Avenue in what authorities are calling an active burglary.

Deputy Ryker Nott responded to the scene early that morning and found an open door to the residence. Inside, he discovered Horne sitting in a chair, drinking a beer. According to the deputy’s report, Horne admitted to forcing his way into the home.

When asked to stand up for arrest, Horne initially refused, continuing to drink his beer. Deputy Nott repeated his order to comply, but Horne responded defiantly, asking, “What if I don’t stand up?”

In an attempt to apprehend Horne, Deputy Nott pulled out his baton, and when Horne resisted, the deputy grabbed his wrist. Horne struggled and pulled away, prompting Nott to push him through the chair and onto the kitchen floor. As the struggle continued, Officer Blankenship of the Chillicothe Police Department arrived at the scene and reportedly attempted to subdue Horne, during which Horne tried to kick the officers. In response, Officer Blankenship struck Horne in the face, allowing Deputy Nott to flip him onto his stomach and place him in handcuffs.

Once in custody, Horne continued to resist and attempted to spit as officers escorted him down the stairs and to the patrol vehicle. He was eventually transported to the Ross County Jail, where he continued to show defiance, warning Deputy Nott that he would not comply with jail staff.

During transport, Horne reportedly vomited in the back of the patrol vehicle. Upon arrival at the jail, Deputy Nott and Deputy Ramsey had to assist Horne from the vehicle and into the facility. Jail staff were notified of Horne’s behavior and potential need for medical attention.

Investigators later spoke with the resident of the home, who confirmed that Horne had been previously trespassed from the property and had been denied entry. The resident stated Horne had not physically hurt anyone during the incident.

Horne is facing charges related to burglary and resisting arrest. Authorities are continuing their investigation into the incident.
