Ross County – Man Arrested After Being Found Passed Out at Rallys’ Drive-Thru

CHILLICOTHE – A man was arrested and charged with being under the influence after sitting idle in the Rally’s drive-thru.

According to the Chillicothe Police Department, they were called to 133 North Bridge Street Rallys around 5:55 am on 6/17/23 when an employee had reported that a man in a black Cadillac was sitting stationary in the drive-thru line unconscious. This was confirmed by the arriving police officer who walked up to the idling black Cadillac and knocked on the window to wake him up. When the man put it in park and got out of the vehicle the officer reported the smell of alcohol on him. At first Eric Withrow, 39 said that he was not under the influence but police reported that he had glassy eyes, and struggled to maintain his balance while outside of the vehicle. Eventually, the man admitted to having been at the Wobbly Ghost and had several beers and shots before leaving.

Withrow who has been arrested twice before for OVI once in 2008 and once in 2011 was arrested again for OVI and taken to Ross County Jail
